Delinquent Assessments - Members of Military

Servicemembers Civil Relief Act. This Act protects active duty military personnel and their dependents. It was previously known as the Soldiers and Sailors Relief Act.

The Act provides that a foreclosure resulting from delinquent assessments is invalid if executed while the delinquent owner is in the military or within 90 days thereafter. Notwithstanding, associations may record an assessment lien against the delinquent owner's unit. However, they cannot initiate foreclosure action on the owner's unit without court approval.

Associations that violate the Act can be severely fined. Agents of the association can also be fined.
